Mountain Brief Topanga Beta Tester Agreement Version: 2026-08-09-v4 This Agreement is between you (“Tester”) and Mountain Brief / the Topanga pilot operators (“Mountain Brief”). Mountain Brief is operated in partnership with TCEP for the Topanga community. This beta track is for resident-app evaluation only, including the gated web preview and (when invited) installable builds. 1. Purpose and limited license You are granted a personal, non-exclusive, non-transferable, revocable license to access the gated web preview and/or install and use beta app builds solely to evaluate and provide feedback for the Topanga pilot, and only after Mountain Brief approves your request. No other rights are granted. You may not sublicense, sell, rent, or redistribute the app, preview, or access credentials. 2. Ownership of intellectual property Mountain Brief and its licensors retain all right, title, and interest in and to the Mountain Brief platform, including the app, software, designs, user interfaces, workflows, documentation, trademarks, trade secrets, and any related materials, whether or not marked confidential. Feedback, suggestions, bug reports, ideas, and other materials you submit (“Feedback”) become the exclusive property of Mountain Brief to the fullest extent permitted by law. You assign (and agree to assign) to Mountain Brief all rights in Feedback, including the right to use, modify, and commercialize Feedback without payment, attribution, or further approval. If assignment is not enforceable, you grant Mountain Brief a perpetual, irrevocable, worldwide, royalty-free license to use Feedback for any purpose. Nothing in this Agreement transfers ownership of your pre-existing materials that you do not submit as Feedback. Mountain Brief claims no ownership of official government alert content (e.g. LA County / Genasys). 3. Confidentiality “Confidential Information” includes non-public information relating to Mountain Brief or the pilot, such as: unreleased features, UI, builds, or roadmaps; test credentials, invite codes, or internal URLs; operational details, architecture, or integrations shared for testing; screenshots, recordings, or descriptions of unreleased builds; and the existence of non-public capabilities discussed in pilot channels. You will not disclose, publish, or share Confidential Information outside approved TCEP / Mountain Brief pilot channels without prior written permission. You will use Confidential Information only for authorized testing. These obligations continue after testing ends for information that remains non-public. 4. No reverse engineering; no competitive use; no AI analysis You will not, and will not attempt to: (a) reverse engineer, decompile, disassemble, decrypt, or otherwise derive source code, models, schemas, APIs, or underlying ideas from the app or related systems, except to the limited extent such restriction is prohibited by law; (b) probe, scrape, fuzz, or instrument the app or backends beyond ordinary end-user use, or circumvent access controls; (c) copy distinctive UI, flows, copy, branding, or product design for a competing product or commercial offering; (d) use beta access to build, train, improve, or evaluate a competing alerting, emergency-status, or community-comms product; or (e) upload, paste, photograph, screen-record, or otherwise provide the app, its UI, screenshots, recordings, logs, network traffic, credentials, or other Confidential Information to generative AI / LLM tools, coding assistants, or similar automated analysis systems for analysis, reconstruction, reverse engineering, or competitive research — unless Mountain Brief expressly authorizes that use in writing for a specific purpose. Ordinary resident use of an approved installed app on your own device is allowed. Reporting bugs and UX issues through the official Mountain Brief feedback form or approved pilot channels is allowed and encouraged. 5. Web preview vs installable builds The gated Flutter web preview is for evaluation in a browser. It is not TestFlight or Google Play, may differ from native builds, and is not an official alert channel. You may choose preview-only access without installing a native build. Installable builds (when offered) are delivered only after approval, typically by email / store testing invites. 6. Permitted testing conduct Use the app as a resident would. Do not create false emergencies, spam alerts, harass others, or interfere with TCEP / official emergency operations. Do not share TestFlight / Play invites outside people Mountain Brief or TCEP has approved for this beta. 7. Not an official alert system Mountain Brief supports local preparedness and TCEP workflows. It does not replace official LA County / Genasys / emergency alerts. In a real emergency, follow official instructions from authorities. 8. Access; no warranty Beta software is pre-release and provided “AS IS.” Features may change or break. Access may be suspended or revoked at any time. This Agreement does not grant source code, infrastructure, admin, or production-system access. Approval may be denied or withdrawn at Mountain Brief’s discretion. 9. Term and survival This Agreement starts when you accept it and continues until Mountain Brief ends your beta access or terminates the program. Sections 2–4, 7, and 9 survive termination. 10. Acceptance By checking “I agree” and continuing, you confirm you are authorized to accept this Agreement, that you have read it, and that you agree to it.
